SKOOL COMMUNITY – WAIVER, CONSENT & TERMS

This Waiver, Consent & Terms (Terms) govern your participation in The Peak Awakening Skool Community (Community), operated by Peaking Through Consultancy Inc., doing business as The Peak Awakening by Peaking Through Consultancy Inc. (“we,” “us,” or “our”).

By joining, accessing, or participating in this Community, you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree, you must not join or participate in the Community. 

1. Nature of the Community (Education Only)

The Community provides educational content, coaching, and personal development resources related to performance, leadership, mindset, embodiment, and personal growth.

You acknowledge and agree that:

  • The Community is not medical, psychological, therapeutic, legal, or financial advice

  • Nothing in the Community creates a doctor-patient, therapist-client, or other professional relationship

  • You are solely responsible for your decisions, actions, health, and outcomes

Always consult qualified professionals regarding medical, mental health, legal, or financial matters.

2. Voluntary Participation & Assumption of Risk

Participation in the Community is voluntary.

You understand that personal development and coaching may involve:

  • Emotional reflection

  • Increased self-awareness

  • Discomfort associated with growth or change

You voluntarily assume all risks, known or unknown, arising from participation, and agree that you are participating at your own discretion and responsibility.

3. No Guarantees or Outcomes

We make no guarantees, representations, or warranties regarding:

  • Results

  • Income

  • Performance outcomes

  • Personal transformation

  • Business or life success

Individual results vary and depend on many factors beyond our control.

4. Intellectual Property (Critical Section)

All content shared in the Community — including but not limited to:

  • Written posts

  • Videos

  • Audio recordings

  • Trainings

  • Frameworks

  • Exercises

  • Concepts

  • Language

  • Downloads

  • Coaching responses

(“Content”) is owned or licensed by The Peak Awakening by Peaking Through Consultancy Inc. and is protected by Canadian and international intellectual property laws.

You agree that you will NOT:

  • Copy, reproduce, record, screenshot, or distribute Content

  • Share Content outside the Community

  • Use Content commercially

  • Teach, license, or resell any Content

  • Create derivative works based on the Content

Without our prior written consent.

Access to the Community grants you a limited, non-exclusive, revocable licence for personal, non-commercial use only.

5. Confidentiality & Community Integrity

You agree to respect the confidentiality of the Community and other members.

You must not:

  • Share personal disclosures made by other members

  • Record live sessions unless expressly permitted

  • Use the Community for competitive, extractive, or research purposes

We reserve the right to remove any member who violates trust, confidentiality, or Community standards.

6. Community Connection & Non-Solicitation

Connection, dialogue, and relationship-building within the Community are strongly encouraged. However, the Community is not a marketplace.

You agree that you will not, without our prior written consent:

  • Solicit, pitch, market, or promote any product, service, program, event, or offer

  • Send promotional messages or sales outreach to members via posts, comments, or private messages

  • Use the Community to generate leads, conduct market research, or recruit clients, customers, or partners

This restriction applies to both public posts and private communications initiated as a result of participation in the Community.

We reserve the right, at our sole discretion, to:

  • Remove any content that violates this section

  • Restrict, suspend, or terminate your access to the Community

  • Take such action without prior notice or refund

These measures exist to protect the integrity, trust, and safety of the Community.

A breach of this section constitutes grounds for removal under Section 9.

7. User Content

You may post or share content (“User Content”) within the Community.

By doing so, you grant us a non-exclusive, royalty-free, worldwide licence to use, display, and distribute such User Content within the Community and related offerings.

You confirm that:

  • You own or have rights to your User Content

  • Your User Content does not infringe third-party rights

  • Your User Content complies with applicable laws

We may remove User Content at our sole discretion.

8. No Recording or Redistribution of Live Sessions

Unless expressly authorized in writing:

  • Live calls, trainings, and coaching sessions may not be recorded

  • Screen capture, transcription, or redistribution is prohibited

9. Suspension or Removal

We reserve the right to:

  • Suspend or terminate your access

  • Remove you from the Community

  • Delete Content or User Content

At any time, without notice, for conduct we deem inappropriate, unlawful, competitive, or harmful to the Community.

No refunds or compensation will be provided in such cases in situations where you have paid for content or training.

10. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any loss, damage, or injury (direct or indirect) arising from:

  • Participation in the Community

  • Use of Content

  • Decisions made as a result of participation

  • Technical issues or platform outages (including Skool)

You participate entirely at your own risk.

11. Indemnification

You agree to indemnify and hold harmless Peaking Through Consultancy Inc., The Peak Awakening, and its officers, contractors, and representatives from any claims, losses, damages, or expenses arising from:

  • Your participation

  • Your User Content

  • Your breach of these Terms

12. Platform Disclaimer (Skool)

This Community is hosted on the Skool platform.

We are not responsible for:

  • Skool’s availability or functionality

  • Data loss or outages

  • Platform-level privacy or security issues

Your use of Skool is also subject to Skool’s own terms and policies.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of Ontario, Canada.

You irrevocably submit to the exclusive jurisdiction of the courts of Ontario.

14. Severability

If any provision of these Terms is found unenforceable, the remainder will continue in full force and effect.

  • You have read and understood these Terms

  • You voluntarily agree to them

  • You accept full responsibility for your participation
